Non-resident vendors/letters of no audit and solicitors’ secondary liability
Mr Ken Murphy, Director General of the Law Society, wrote to the Minister for Finance in November 2018 regarding ongoing difficulties with disposals of property for non-resident vendors. The letter set out the concerns of the profession as regards solicitors’ secondary liability in acting for non-residents and the issues relating to the application for letters of no-audit. No response has been obtained to date. Revenue have agreed to a further meeting to discuss a practical solution:

VAT on solicitors’ professional fees - non EU
If a legal service provided does not relate to a specific property and the recipient of the service is not resident in the EU, there is no VAT on legal services.

Stamp Duty on ROS - Help Guides
There are help guides on Revenue.ie which contain useful information on how to complete various types of stamp duty returns, including:
- Amending a stamp duty return
- Stamping a counterpart when the return has already been filed, and
- Notifying Revenue of a clawback.
