New District Court Civil Procedures
The District Court (Civil Procedure) Rules 2014 (SI 17 of 2014) make significant changes to District Court civil procedure.
The District Court (Civil Procedure) Rules 2014 (SI 17 of 2014) make significant changes to District Court civil procedure.
These changes apply from 3rd February, 2014 and coincide with the increase of the District Court’s jurisdictional limit to €15,000.
The new Rules provide that District Court civil proceedings are commenced by the filing for issue and service of a ‘claim notice’ or PI Summons (as appropriate), which will remain valid for service for one year after the day it is filed. They also bring into effect a new Scale of Costs.
Any District court civil proceedings in being before 3rd February, 2014 shall be continued and determined as if these rules had not taken effect.
