Aim and Objectives

The Assisted Decision-Making (Capacity) Act, 2015 commence in April 2023 and has wide ranging implications for practitioners. This live webinar will explore the practical effect on practice 6 months on and will be an opportunity to hear from two practitioners with knowledge and experience of the new legislation.

Speakers 
Aine Hynes S.C, St John Solicitors
Áine is a partner in public and administrative law in St.John Solicitors.  Áine has been a member of the Council of the Law Society and many of its committees (which include Litigation, Regulation of Practice and Education) since 2007 and served as President of the Dublin Solicitors Bar Association (2016 - 2017). She was appointed by Minister Lynch to the Expert Steering Group on the Review of the Mental Health Act 2001 (2012-2015) and was a member of the Regional Advisory Board of the National Advocacy Service (2013-2017). In May 2022, she was appointed by the Minister for Justice to the Civil Legal Aid Review Group. Áine currently chairs the Law Society Mental Health Law and Capacity Taskforce and has made extensive submissions to the department of Children, Equality, Disability, Integration and Youth on appropriate amendments to the Assisted Decision-Making (Capacity) Act 2015. Her novel submissions on transitional arrangements were accepted by the department, thus ensuring a more orderly transition from wardship to the new legal capacity framework. Áine was one of the first solicitors appointed Senior Counsel in October 2020, following a historic move permitting solicitors to be granted patents of precedence.

Richard Hammond S.C, Hammond Good Solicitors
Richard Hammond S.C. is a Partner with Hammond Good, Solicitors in Mallow in north County Cork. He is a member of the Council of the Law Society.  He is or has been involved in a number of committees of the Law Society of Ireland including inter alia the Probate, Administration & Trusts Committee, the Mental Health & Capacity Task Force, the Gazette Editorial Board, the Professional Indemnity Insurance Committee, the Education Committee, and the Complaints & Client Relations Committee.  Richard is a past President of the Southern Law Association and also one of the first solicitors to be made senior counsel.

All profits from this event will go to the Attracta O’Regan Ovarian Cancer PhD Scholarship.

Attracta O’Regan, the Head of Law Society Professional Training passed away on July 2, 2023 because of complications relating to ovarian cancer. There is currently no accurate test for the early detection of this type of cancer. In Attracta’s memory, her husband, Ultan Bannon and their family have partnered with Breakthrough Cancer Research to launch a research scholarship targeting the early detection of ovarian cancer. A major challenge in the clinical management of ovarian cancer is the late stage of diagnosis. Approximately 7 in 10 women are diagnosed at a late stage, when clinical management is more challenging and survival is lower. More than 400 women are diagnosed with ovarian cancer each year in Ireland, and there are approximately 295 deaths. These are not just numbers; they are someone's wife, mother, sister, daughter or friend. Fundraising now begins for the 3-year €149,000 scholarship.
