Water charges - change in practice

Section 48 of the Environment (Miscellaneous Provisions) Act 2015 inserted a section 3A into the Water Services Act 2014, under which an obligation was placed on vendors’ solicitors to discharge any unpaid water charges from proceeds of sale.

Section 5(1)(b)(ii) of the Water Services Act 2017 has now repealed section 3A of the Water Services Act 2014. There is no longer an obligation on vendors’ solicitors to make enquiries of Irish Water about amounts due and/or to discharge arrears from sale proceeds.

The standard Requisitions on Title will be amended accordingly in due course, as will the non-title information sheet in the standard Conditions of Sale.
