Common law motions backlog move

A registrar has been assigned to sit in a court on Monday, 20 July, to deal with consent applications in respect of motions originally listed for hearing in the Common Law List on 27 April this year.

Motions originally listed for hearing on 20 July will not be heard on that date and will be relisted for hearing on a future.

Applications

Consent applications will be taken in respect of orders, adjournments and any motions to be transferred out of the list as the motion would take more than 15 minutes at hearing.

If a motion is not to be dealt with by way of a consent application there is no need to attend court on this day, practitioners have been told.

All motions not dealt with by way of consent application will be deemed to be still “live” and will be listed for hearing at a future date.

Staggered times

To comply with social distancing requirements, staggered times have been allocated for practitioners to attend court for these consent applications.

The Courts Service intends to publish further information on the hearing of the balance of the motions still "live" after Monday’s exercise has been completed. Practitioners are urged to check the Courts Service website regularly for more information.
