IRB mediation service

The Injuries Resolution Board (IRB) has introduced a mediation service for employer liability claims.

About the process

The service will be based by telephone, with the mediator listening to all parties through a series of separate calls aiming to reach a mutually acceptable solution.

If agreement is reached, the mediator will draft a written version of anything agreed orally.

This will then go to both parties to sign and return, with a ten-day cooling off period post-signature. After 10 days, the agreement becomes legally binding, and the IRB will issue an Order to Pay.

In certain circumstances, an in-person mediation can be arranged at the discretion of the Injuries Resolution Board.

Claimants who wish to avail of the mediation service must tick 'yes' to the mediation question in the employer liability section of the online claim form. Claimants can choose to have a solicitor accompany or represent them at the mediation.
