December 2023 Justice and Law Reform update

This month’s update centres on events and work of the Business Law, Conveyancing, Environmental & Planning Law and Human Rights Committees.

Business Law

The Business Law Committee completed the following submissions over the past several months which you can view online:

Other submissions were made by the Committee in February and June to the Department of Enterprise, Trade and Employment on issues arising from the transposition of the Corporate Sustainability Reporting Directive (EU) 2022/2464 (CSRD) into Irish law and the Companies Act 2014, and in August to the Law Reform Commission on foot of their Consultation Paper on Liability of Clubs, Societies and other Unincorporated Associations and to the Central Bank on the Individual Accountability Framework (CP153).

In its successful annual conference in November, held in the Law Society’s Moya Quinlan Lecture Theatre, various panels focused on anti-money laundering in relation to certifying business ownership, new Irish competition law legislation and key things to think about when buying or selling a private company.

Members of the committee continue to engage with different stakeholders on a range of business law issues, such as the Registrar of Companies regarding Directors’ PPSNs and the closure of public office of the CRO.

Conveyancing

Due to the introduction of compulsory registration and the increased availability of title insurance, the Conveyancing Committee updated their 1997 practice note on Insurance company bonds in relation to lost documents and defects on title – view the 2023 practice note.

Environmental & Planning Law

The Law Society held its inaugural Climate Justice conference in November entitled 'Policies and Actions for a Climate Responsive Justice Sector’ addressing key issues affecting climate and environmental justice, including the Planning and Development Bill 2023, biodiversity and the climate crisis, ethics and climate conscious lawyering and climate litigation. Presentations can be downloaded from the Committee’s area of the website. The committee is working on a Climate Change Resolution to be published early next year.

Human Rights

In November, the Human Rights Committee’s sold-out conference focused on digitising justice, including technology as an enabler of access to justice and other innovations. To learn more, access two of the presentations below:
