DPC begins probe into Google AI system
The data-protection watchdog has opened an inquiry into Google’s use of personal data for the development of its AI (artificial intelligence) model Pathways Language Model 2 (PaLM 2).
The Data Protection Commission (DPC) said that the cross-border probe was looking into whether Google complied with its obligations under the GDPR to carry out an assessment before processing data from EU/EEA users as part of the development of the AI system.
“A Data Protection Impact Assessment (DPIA), where required, is of crucial importance in ensuring that the fundamental rights and freedoms of individuals are adequately considered and protected when processing of personal data is likely to result in a high risk,” the watchdog stated.
‘High risk’
The DPC said that the inquiry was part of wider efforts by EU bodies to regulate the processing of personal data in the development of AI models and systems.
Article 35 of the GDPR provides that a DPIA is required where a type of processing, using new technologies, and taking into account the nature, scope, context and purposes of the processing, is likely to result in a high risk to the rights and freedoms of individuals.
The inquiry is taking place under section 110 of the Data Protection Act 2018.
