The Workplace Relations Commission (WRC) has published decisions and recommendations from 2 to 9 September 2024.

September employment case law

Cases and issues covered include:

  • Section 13 of the Industrial Relations Act, 1969 considered in the context of voluntary workers (A Voluntary Worker v A Professional Accreditation Organisation, IR - SC - 00002602);

  • a settlement agreement on the termination of employment precluding an action under the Protected Disclosures Act 2014 (Brendan Flanagan v Ulster Bank Ireland Designated Activity Company, ADJ-00052192); and

  • consideration of whether dismissal was an appropriate sanction for an employee allegedly sleeping in the work canteen (Szymon Gasiorowski v Super Valu Operating Partners Ireland t/a Super Valu, ADJ-00048674).
