Registration of charges in Land Registry
The Conveyancing Committee has been made aware of certain issues relating to the registration of charges.
- Conveyancing
The Conveyancing Committee has been made aware of a pattern of Land Registry rejections and queries concerning the standard form residential property charge, with the reason given that the form is not in the correct format. The Land Registry has confirmed to the Conveyancing Committee that these applications were rejected/queried in error.
Where this is the only reason for rejection provided by the Land Registry, practitioners are advised to relodge those applications without amendment to the charge as soon as possible. If an application has been queried on this basis, practitioners can respond to the effect that the format has been approved by the Land Registry.
