Criminal legal aid fees update

The Department of Justice, Home Affairs and Migration published updated procedures on the payment of criminal legal aid fees in July.

Many of these procedures are being implemented shortly.  Two new forms, the LA10 and CF1 (consultation), take effect from 24 August 2025.  

What’s changed?

The most relevant amendments are set out below, with particular emphasis on Appendices 6 and 7.

  • Appendix 1 (Page 29), the new fee payable for Criminal Legal Aid to practitioners in the District Court and Appeals to the Circuit Court (as set out in S. I. No. 742 of 2024).
  • Appendix 2 (Page 30) outlines the fee changes for Circuit Court and Higher Courts.
  • Appendix 3 (Page 31) outlines other types of fees payable, including Prison Visits and consultation fees.
  • Appendix 4 (Page 32) tables 1 and 2 outline maximum fees payable to witnesses.
  • Appendix 6 (Page 39) outlines the new procedure for applications for approval and payment for Review of Disclosure.  
  • Appendix 7 (Page 42) outlines the new process for claiming Photocopying Expenses. 

Restoration of fees

The cuts to criminal legal aid fees were partially reversed in 2024 and 2025. The Law Society and Criminal Law Committee continue to advocate for full restoration of fees.
