Assisted Decision Making (Capacity) Act commencement delayed


The proposed commencement of the Assisted Decision Making (Capacity) Act, 2015 will not be enacted before the summer recess.


This is because the required amending legislation will not be passed before this time.  The Probate, Administration and Trusts Committee reminds practitioners that Enduring Powers of Attorney executed under the current 1996 legislation will be administered under the 1996 legislation regardless of date of registration and refers practitioners to its June 2016 eZine article in this regard.
