Bill to regulate enforcers of court orders
Amended legislation is to expand the remit of the Private Security Authority (PSA) to include security personnel enforcing court orders for evictions and repossessions.
The Private Security Services (Amendment) Bill 2021 was published yesterday (21 April) after Government approval earlier this week.
New category
The bill’s main provision is an additional category and a definition of ‘enforcement guard’ in the list of security services covered by the Private Security Services Act 2004.
This will require enforcement guards to obtain a licence to operate, and will ensure that they are subject to the training standards and licensing regime operated by the regulatory body.
Other amendments will allow the PSA to refuse to renew a licence, or to suspend or revoke a licence, of a body corporate for the actions of its members. The register of licensed persons will also be available for inspection free of charge to members of the public.
The bill also includes a new offence if “impersonating an inspector” of the PSA.
