Leaving Cert student wins High Court challenge

An out-of-school Leaving Cert student has won a High Court challenge over a Department of Education decision to deny him calculated grades.

Mayo student Elijah Burke has won his bid to get the Department of Education to reverse its decision, which the ruling called “arbitrary, unfair, unreasonable and contrary to law”.

Judge Charles Meenan ruled that an external teacher should be appointed in place of Elijah Burke's mother and give him estimated Leaving Cert grades.

The student was entirely home schooled by his mother, which was deemed to present a conflict of interest in the calculated grades process.
