The Government has formally advised the President to appoint Mr Justice Gerard Hogan to the Supreme Court.
The Courts Service says arrangements will be made for the appointment and swearing in of Mr Justice Hogan in due course.
He is currently the advocate general of the European Court of Justice (CJEU), where he has served since October 2018.
The vacancy at the court arose after Ms Justice Mary Irvine was appointed as President of the High Court last year.
Mr Justice Hogan was a judge at the High Court between 2010 and 2014, and at the Court of Appeal from 2014 to 2018.
Separately, it has been announced that Mr Justice Liam McKechnie retired from the Supreme Court on 19 April after reaching 70 years of age.
