Fresh Practice Note from Conveyancing Committee

The Law Society’s Conveyancing Committee has published new guidance for practitioners outlining the appropriate steps to take in sales where first registration is pending in the Land Registry.

Compulsory

During recent webinars co-hosted by Law Society and Tailte Éireann, members of the Conveyancing Committee and Tailte Éireann’s Land Registry officials discussed the registry’s processes where a property is sold while an application for compulsory first registration of that property’s title is awaiting registration in the Land Registry.

As first registration applications can sometimes take a considerable time to complete, the Conveyancing Committee has received queries relating to the appropriate practice to be followed where a sale is to take place prior to completion of first registration.

The Conveyancing Committee has published guidance to help solicitors with this matter.
