US appeals court suspends tariffs order

A US federal appeals court has put a stay on an order made by the Court of International Trade earlier this week on tariffs imposed by the Trump administration. 

The trade court found that President Trump did not have the authority to impose unlimited tariffs on imported goods from the rest of the world. 

Several states and businesses had taken the case, arguing that the International Emergency Economic Powers Act (IEEPA) of 1977 did not delegate to the US president the authority to impose such tariffs. 

‘Political branches make policy’ 

The Trump administration had criticised the ruling and immediately filed an appeal. 

"The political branches, not courts, make foreign policy and chart economic policy," it said in the filing. 

The Court of Appeals for the Federal Circuit granted the US government’s request for an immediate administrative stay on the trade court’s order until further notice while it considered the appeal. 

The businesses and US states that took the case have been given until 5 June to respond.
