Study on clinical litigation pre-action protocols

A study on clinical litigation and ‘pre-action protocols’ in Ireland is underway, led by solicitor Nicola McGuinness as part of her LLM in Public Law at DCU.

Under the Legal Services Regulation Act 2015, Ireland will introduce a pre-action protocol in clinical-negligence cases.

Input

The most workable version of the protocol would benefit from input by all parties who will be impacted by it., McGuinness points out.

Those in any of the following groups are invited to participate in the study:

  • Health-service users or patients – individuals with claims arising from healthcare provision,
  • Health-service providers – professionals and organisations delivering healthcare services,
  • Lawyers – legal practitioners with experience in clinical litigation.

Participants will be invited to share their views on clinical litigation through a fully online, completely anonymised survey.

Anonymity is guaranteed and no personal or identifying information will be collected.

Results will be compiled and published in aggregated, anonymised format.
