Submission on the Offences Against the State Acts

The Law Society has made a submission to the Independent Review Group on the Offences Against the State Acts 1939 to 1998.

The Society refers to the previous review chaired by Mr. Justice Hederman, and notes that many of the recommendations from the 2002 Hederman Report were not implemented.

Meanwhile, the intervening years has seen the introduction of a considerable body of legislation tended to bolster or add to the provisions of the Acts, while human rights legislation in Ireland has evolved over the last 20 years.

The submission makes observations on:

  • The Special Criminal Court,
  • oversight of referrals to the Special Criminal court, and
  • the offence of withholding information.
