Consultation on draft code of practice for legal practitioners

The Decision Support Service has launched a consultation regarding a draft code of practice for legal practitioners on how to engage with and advise people who may lack capacity to make decisions.

The purpose of the code of practice for legal practitioners is to provide guidance on good practice in engaging with, and advising, a “relevant person” as defined by the Assisted Decision Making (Capacity) Act 2015.

Áine Hynes Chair of the Law Society Task Force on Mental Health Law and Capacity Law, encourages practitioners to participate in this survey, so that the final code can represent the views of solicitors and a practical code taking those views into account, is in place before the full commencement of the Act next year.

Participants can view the draft code on the Decision Support Service website and can give their feedback via an online questionnaire or feedback form. The consultation process will remain open until 07 January 2022.
