Priority of charges and E-filing under Companies Act 2014

22/05/2015 15:33:18

The Companies Act 2014 introduces new filing procedures for the registration of charges and a new priority regime.

Solicitors should be aware that from 1 June 2015 the Companies Registration Office (CRO) will be using an e-filing facility to establish certainty on the date and time of filing for the purposes of priority, and visibility of charge submissions on the Register.

All of the new forms will be available for online submission with a Revenue Online Services (ROS) signature.

The CRO has asked the Minister to make an Order mandating e-filing with a ROS signature in accordance with Section 897 of the Companies Act 2014.

Be prepared

To prepare for 1 June, the CRO has advised that you:

  • Make use of the current e-filing facility on the Companies Registration Environment website (CORE) at www.core.ie
  • Obtain a ROS certificate from Revenue
  • Familiarise yourself with the CRO website, new forms and information leaflet no. 27 - visit www.cro.ie.

For more information about the key changes and the CRO's proposal to make the e-filing system mandatory, read this CRO notice.
