Course Outcomes
This course aims to provide practitioners with an update of the recent trends in banking and security law in Ireland.  The course will look at the implications for practitioners dealing with property transactions and the overall effect on banking and security practice in light of the introduction of the National Asset Management Agency (NAMA).  The course will begin with an introduction to Regulation of Banking in Ireland and discuss on-going supervision, capital requirements, Banking Codes of Practice and Codes of Conduct.  It will then focus on providing an update on best practice in relation to loan acquisition, due diligence, restructuring loans, enforcement actions including a session on advising developer clients whose loans have been transferred to NAMA, appointment of receivers including advising a receiver appointed by NAMA.

Course Structure
The course runs over four months and will be divided into three modules.

Workshops
Workshops are an integral part of the course and aim to be hands on and consolidate what is dealt with in the lectures.  This course will be webcast online however onsite attendance for workshops is strongly advised to maximise the learning experience.

Who Should Attend
The course will have a very practical emphasis and will appeal to in-house solicitors in many of the banking institutions, practitioners who have clients with prospective or ongoing dealings with NAMA or indeed any practitioner in banking, property or general practice acting on behalf of borrowers.  This may also appeal to suitably qualified non-legal professionals such as accountants.

Lecturers & Tutors
Our courses emphasise a practical ‘know how’ approach to the law. Our lecturers and tutors for this certificate will be drawn from members of the profession with significant practice expertise in this area, and may include other consultants such as accountants and/or economists.

Please note: If you are not a qualified solicitor, trainee or barrister – you must send a CV & cover letter for approval. Such applications are subject to a supplemental fee, which amounts to a supplement of €150 in respect of a diploma application and a supplement of €75 in respect of a certificate application.
